The Duties of School Lawyers

Chicago native John Heintz, a former assistant superintendent of operations and the chief legal officer with Niles Township High School District 219 in Skokie, Illinois, is a cofounder and senior legal consultant at Lydian, Inc., in Chicago. John Heintz maintains membership in a number of education and legal organizations, including the Council of School Attorneys.

The primary role of school lawyers is to represent their schools and school districts in all manner of legal scenarios. School lawyers are not only required to have knowledge of various areas of law, but must be able to consult with administrators and faculty on ongoing legal issues, maintain effective independent research, and provide school districts with support in court as a litigator.

School lawyers are indispensable for both private schools and public school districts, as educators and administrators commonly face legal situations on a daily basis and may face more specific legal matters at any time. The regulatory knowledge and state and federal experience of a proficient school lawyer can spell the difference between normal operations and expensive litigation.

Transparency is paramount to the success of a school lawyer. He or she should avoid conflicts of interest at all times and excel as an expert in preventive law. School lawyers must remain apprised of modern school law at all times in order to avoid litigation. Finally, a trusted school lawyer should serve as a member of the National School Board Association Council of School Attorneys.
